Daniel H. Crow, Esq.
PartnerDan Crow is one of the firm’s primary litigation attorneys. He has advocated for owners, construction managers, contractors and design professionals in all aspects of the design and construction process. Dan has litigated numerous complex, multi-party construction cases in federal and state courts, as well as in arbitration, mediation and dispute resolution boards. Dan’s experience encompasses claims for breach of contract, fraud, adjacent property issues, delay damages, impact and loss of productivity claims, construction defect claims, surety bond claims, professional negligence claims, mechanic’s lien claims and violations under the trust provisions of the N.Y. Lien Law.

Dan’s wide range of litigation experience lends insight to the firm’s transactional practice, where Dan represents owners in preparing and negotiating construction contracts. Dan regularly engages in troubleshooting on construction projects.
Representative Experience
- Obtained defense verdict after jury trial of contractor’s $2.5 million breach of contract claim against a school district in Westchester County
- Obtained summary judgment dismissing alleged $30 million fraud claims against principals of construction management company; affirmed on appeal
- Obtained pre-answer dismissal of developer’s $30 million claims for breach of contract; subsequently obtained a second dismissal of same claims on theory of collateral estoppel
- Litigated and obtained favorable settlement for hotel owner claiming damages for architectural malpractice
- Obtained summary judgment dismissing subcontractor’s $8 million claim against construction manager for delay/impact damages
- Obtained summary judgment against developer, which had diverted over $14 million in Lien Law trust funds
- Representing a school district, persuaded a contractor to discontinue its breach of contract action against the school district based on the contractor’s lack of evidence of damages
- Helped construction manager recover its claim in full (over $8 million) from bankrupt owner, while closing out approximately 25 trade contractors alleging claims against the construction manager
- Obtained defense verdict after jury trial of contractor’s $2.5 million breach of contract claim against a school district in Westchester County
